1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of datawithmala.com and all associated courses, materials, and services (the “Platform”), operated by Mala Deep (“DataWithMala”, “we”, “us”). By accessing the Platform or enrolling in any course, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.
2. Eligibility
- You must be at least 16 years of age to use the Platform.
- You represent that all registration information you provide is accurate, complete, and current.
- If enrolling on behalf of an organisation, you represent that you have authority to bind that organisation.
3. Course Enrollment and Access
3.1 Enrollment
Enrollment is confirmed upon receipt of full payment through our LMS platform (lms.dataksha.com). You will receive access credentials to enrolled course materials after payment is confirmed.
3.2 Lifetime Access
Courses sold with “lifetime access” provide access for as long as the Platform operates and the course content remains available. We reserve the right to retire or update course content with reasonable notice.
3.3 Personal Use Only
Your enrollment is for your personal, non-commercial use only. You may not share login credentials, transfer enrollment, or allow others to access courses on your behalf.
4. Payment and Refund Policy
4.1 Pricing
All prices are listed in either Nepalese Rupees (NPR) or American Dollar (USD) unless otherwise stated. Prices are subject to change; the price at the time of purchase applies to your enrollment.
4.2 Payment Processing
Payments are processed through lms.dataksha.com. DataWithMala does not store your payment card details. By purchasing, you agree to the payment processor’s terms.
4.3 Refund Policy
We offer a 7-day money-back guarantee for all courses, provided:
- The refund request is made within 7 calendar days of purchase
- You have not completed more than 20% of the course content
- The request is submitted in writing via WhatsApp
Approved refunds will be processed within 10 business days. Workshop and masterclass fees are non-refundable once the event has occurred.
5. Intellectual Property
5.1 Our Content
All course content, materials, videos, frameworks (including MALA, DTC, THINK and any other frameworks), written materials, and branding are the intellectual property of Mala Deep / DataWithMala, protected under Nepal’s Copyright Act 2059 (2002) and applicable international copyright law. Unauthorised reproduction, distribution, or commercial use is strictly prohibited.
5.2 Your License
Upon enrollment, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the course materials for your personal educational purposes only.
5.3 Prohibited Uses
- Recording, downloading, or screenshotting course videos for redistribution
- Reproducing or sharing course materials (in whole or part) without written permission
- Using our frameworks or materials for commercial training purposes without a licence
- Reselling or sub-licensing access to the Platform
6. User Conduct
You agree not to:
- Misrepresent your identity or qualifications
- Upload or transmit harmful, defamatory, or unlawful content
- Interfere with the technical operation of the Platform
- Use the Platform for any illegal purpose under Nepalese or applicable international law
- Harass or harm other learners or Platform staff
We reserve the right to suspend or terminate access for violations of these conduct standards without refund.
7. Certificates
Completion certificates are issued upon successful completion of a course or module. Certificates represent educational completion and do not constitute professional licensure, accreditation, or governmental certification unless explicitly stated. Dataksha Academy under Dataksha Analytics certificates are recognised within our own learning ecosystem and by partner institutions as noted in course descriptions.
8. Community and WhatsApp Groups
Our WhatsApp learning community is a collaborative space. By joining, you agree to:
- Treat all members with respect and professionalism
- Not share promotional content, spam, or unsolicited advertising
- Keep discussions relevant to learning and professional development
DataWithMala reserves the right to remove members who violate community standards.
9. Limitation of Liability
To the maximum extent permitted by Nepalese law:
- DataWithMala provides the Platform and courses on an “as is” basis. We do not guarantee specific outcomes such as publication of research, career advancement, or job placement.
- Our total liability to you for any claim arising from use of the Platform shall not exceed the amount you paid for the relevant course in the 12 months preceding the claim.
- We are not liable for indirect, incidental, or consequential damages.
Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or any liability that cannot be excluded under applicable Nepalese law.
10. Disclaimers
Our courses provide educational information only. Course content regarding research methodologies, statistics, and AI tools is intended for general educational purposes and does not constitute professional medical, legal, or clinical advice. Always consult qualified professionals for specific professional decisions.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Nepal, including the Contract Act 2056 (2000) and Electronic Transactions Act 2063 (2006). Any dispute arising from these Terms shall be:
- First attempted to be resolved through good-faith negotiation within 30 days
- If unresolved, submitted to mediation in Kathmandu, Nepal
- If mediation fails, subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal
12. Modifications
We may update these Terms at any time. Material changes will be communicated to enrolled users by email and posted on the website with at least 14 days’ notice before taking effect. Continued use of the Platform after such notice constitutes acceptance of the updated Terms.
